Firm fined £500k after worker injured by forklift truck

A manufacturing company in the North West has been fined £500,000 after an employee was struck by a forklift truck (FLT) in Chester.

Encirc Ltd, a glass bottles producer for the drinks industry, failed to take effective measures to ensure its workers were correctly segregated from FLTs, Liverpool Magistrates’ Court heard.

A Health and Safety Executive (HSE) investigation was launched after an employee collided with a FLT on Ash Road, Elton, on the 14 December 2015, which resulted in him breaking his arm.

The inquiry found that the clarity of segregation was well below the standards expected.

The court was also told that in 2007 the firm had been served with an Improvement Notice for poor segregation in the yard and warehouse areas. There had also been an incident involving a FLT in 2008 when an employee was injured.

HSE inspector Jane Carrol said: “Poor segregation leads to accidents. There was a failure to properly plan work and this accident highlights the risks that are involved. Incidents relating to work place transport can be avoided if effective measures are taken.”

Encirc Ltd of Enniskillen, Fermanagh pleaded guilty to a breach of Regulation 17 of The Workplace (Health, Safety and Welfare) Regulations. It was fined £500,000 with £7,290 costs.
